Before Your Write Your Will
Planning for the prospect of passing on isn't pleasant, but it is a necessary task in life. We all want to leave this world knowing that we have cared for our loved ones in the best manner possible, even after we're gone.
That's why the legal system in Ireland recognizes wills: so that the wishes of the deceased can be carried out in the manner he or she would have wanted. Wills provide the opportunity for us to be able to have a say in which of our belongings goes to which family member, friend, or charity; it allows us the chance to remember those who were special to us in life.
The legal part of wills can be very complex and the writing of such an important document is best left in the hands of your solicitor. He or she will know much more about the process of writing a will; however, there are a few things you can do before calling your solicitor to make a will that can make the process run more smoothly:
Make a list of all the property and items that you will want to pass on after you die.
Make a list of all the people you would like to remember in your will.
Combine the two lists so that you know which item goes to which person.
Think about who you would like to act as the executor of your will.
Make a list of any legal issues that might arise about your possessions and property. This is especially important for homes, businesses, business property, and other properties.
If you have minor children, consider who you want to raise them should the unthinkable occur.
Meet with members of your family to discuss your plan. They might think of things that you haven't as well.
Make an appointment to meet with your solicitor to discuss your plans and the legal aspects of making those things happen. Only a solicitor experienced in wills and probate will be able to give you correct legal advice about your will, and guide you through the complex laws associated with it.
