Terminating A Contract
You can terminate your contractual obligations in a number of ways. The most common is by performing the obligations of the contract. If, however, there is a problem performing the contract obligations, you can also terminate a contract by rescission, breach, or impossibility of performance.
Impossibility of Performance
The performance refers to the completion of contractual obligations. Once the performance is completed, neither party is further obligated to owe anything. Impossibility of performance might terminate a contract if some unforeseen happening precludes the completion of the performance.
Rescission
A contract may be rescinded by either of the parties via legal means, or by both parties through an agreement to rescind the contract. A minor may always rescind a contract due to a minor's incompetency to make a contract.
Breach of Contract
A breach of contract may occur when a party:
- Refuses to perform the obligations of the contract
- Performs an act that violates the terms of the contract
- Prevents the other party from performing its obligations.
