Solicitor, Damian M. Nolan ‘cut his teeth' in the family law courts in Los Angeles, California. Mr. Nolan has litigated more than 1,000 family law matters and there is very little in the family law arena that Mr. Nolan hasn't dealt with. Mr. Nolan's experience includes not only drafting divorce and other family law documents and negotiating with other solicitors, but also personally appearing in court as the client's advocate and arguing the case zealously.

Solicitor, William A. James has been practising law for nearly 40 years and has dealt with many divorces and all other family law matters in Dublin, Meath and Louth. Mr. James is very respected in the legal community and many solicitors refer family law matters to him because of his experience and general knowledge in family law matters.

It took quite a while for divorce to become legal in Ireland but it finally happened in 1996. Our system is different than other jurisdictions insofar as we do not recognize the ‘clean break'.

When applying to the courts for a divorce, you must meet the following conditions:

  • You and your spouse must have lived apart for four of the prior five years
  • There must be no practical possibility of reconciliation
  • Provisions for maintenance of the spouse and/or dependent children must have been made

The court will consider many factors before granting either a judicial separation or a divorce. Among the considerations are first and foremost, the well being and custody of the children. After that, there are ancillary issues of the family home and other marital property; maintenance, pension rights, rights of succession,

Although divorce is not based on fault, the court is nevertheless entitled to consider the actions and behaviour of both parties when making ancillary orders.
