Personal Injury Law in Ireland

There are many areas you may encounter that would require the advice of a solicitor, especially in the area of personal injury.

Traditionally, when a party was involved in an accident he/she sought the advice of a solicitor who acted on their behalf with the insurance company to recover compensation. However, over the years things changed. Because a few people engaged in fraudulent and/or frivolous claims, the insurance companies were able to mount aggressive public relations campaigns demonizing lawyers and Plaintiffs alike. The result was that the government introduce the Personal Injury Assessment Board (PIAB) to “take over” the claims and remove the legal experts from the system.

Now, after some years of the PIAB there are huge backlogs in the system. Some injured parties received adequate compensation and many did not. Indeed, many did not even bother to proceed with their claim. This is an unacceptable situation when so many people are not compensated for accidents in which they were involved through no fault of their own. The PIAB try very hard to deal with the myriad of claims received, but the recent trend has been for many injured parties to again seek legal assistance. It must be remembered that the PIAB is a bureaucratic body essentially instituted at the behest of the insurance companies and big business.
