Injuries on Public Transportation

There have been some questions recently regarding how to protect one's self in the event of injuries sustained in an accident while using public transportation.

The first thing you need to know is that the public transportation system in Ireland will be carrying insurance to cover passenger injuries if an accident should occur. If you are injured in a public transportation accident, you should contact your solicitor as soon as possible with as many details as you can gather.

But the real question that is typically asked is if a ticket for the bus or train is evidence that you are entitled to compensation should you be injured. The answer lies in a rather grey area.

Typically, the ticket is only proof that you were, indeed, on the mode of transportation, but it could prove useful in building a case for personal injury compensation against the insurance company.

In the world of Irish personal injury law, most injuries would be treated the same way as any other kind of personal injury sustained through no fault of your own. As always, you should contact your solicitor for advice and help for your personal injury case. Your solicitor would then intercede on your behalf with the insurance company for the public transportation system. Depending on what happens in those talks, the case may or may not be referred to the PIAB, and, further, may or may not be allowed to be heard in court.

Injuries sustained on public transportation are very rare, so you should not reconsider using the train or buses. Mass transit is healthier for the environment, so a possible - a very unlikely - injury due to using public transportation should not be a consideration in your decision to use trains or buses. However, as with most aspects in life, it is always best - and safest - to be aware of what is happening around you.
